פטור מאגרה בבית המשפט לתביעות קטנות: ניתוח תאורטי ואמפירי | אסף טבקה ואור דפוס (כרך לב)

המאמר עוסק באפיונה של זירה דיונית מובחנת: הליך הפטור מאגרה בבית המשפט לתביעות קטנות. מה מתרחש בזירה זו? באילו אופנים בית המשפט מעצב את הדיון המשפטי ואת ההכרעה השיפוטית בה? ואילו בעיות וקשיים נובעים ממצב דברים זה ומחייבים תיקון במבט צופה פני עתיד?

על מנת לבחון את הדברים נכוחה, המאמר פועל בשלושה נדבכים. בחלקו הראשון הוא מציג נתונים אמפיריים של כל ההחלטות בעניין זה שהתקבלו מ־1.1.2010 עד 1.1.2025 ופורסמו במאגרים השונים. בחלקו השני הוא מחפש הסבר ראשון לנתונים אלו בדמות זיהוי סוג השחקנים המצויים בעמדת מבקשי הפטור וסוג השחקנים המצויים בעמדת המשיבים על בקשת הפטור. לאחר שהוא שולל הסבר זה, הוא מציג, בחלקו השלישי, הסבר בר תוקף לנתונים אלו: זיהוי דפוסים הליכיים ושיפוטיים שיש בהם כדי לעצב את הזירה הדיונית בהליך מובחן זה באופן שמעניק יתרון מובנה למשיבים בהליך וחיסרון מובנה למבקשים בו.

שלושת נדבכי הדיון חושפים פרדוקס: בזירה שתכליתה הנגשת המשפט לציבור בולט סירוב שיטתי לאישור בקשות פטור מאגרה, דפוס שמצמצם הנגשה ומרחיק את הציבור מכניסה לבית המשפט. הליך שהיה אמור לרכך פערי כוח משמש בפועל מנגנון סינון המחמיר דווקא עם מבקשי הפטור, ובכך משעתק – במקום לצמצם – את אי־השוויון שהוא יכול והיה צריך לתקן. תרומתו של המאמר היא אפוא כפולה: הוא הופך תצורה דיונית סמויה ובעלת משקל חלוקתי לזירה גלויה; והוא מחלץ, באמצעות תיאור אמפירי, הסבר מוסדי שיטתי לאופני הפעולה המוסדיים המנביעים את ההכרעות בשאלות הפטור מאגרה הלכה למעשה. דיון זה, על נדבכיו השונים, מאפשר לא רק זיהוי עומק של בעיות היסוד המאפיינות את הליך הפטור מאגרה בטריבונל זה, אלא אף את התחלתה של חשיבה מחודשת על אודות דרכי העיצוב הרצויות של מנגנון הפטור בהליך מובחן זה – חשיבה המבוססת על תיקון אפשרי צופה פני עתיד.

Court-Fee Exemption in the Small Claims Court: A Theoretical and Empirical Analysis | Assaf Tabeka & Or Dafos (vol. 32)

The article examines a distinct procedural arena: the court-fee exemption process in the Small Claims Court. What occurs within this arena? In what ways does the court shape both the legal proceeding and the judicial decision rendered within it? And what problems and difficulties arise from this state of affairs, requiring future-oriented reform?

To address these questions, the article proceeds in three stages. The first part presents empirical data concerning all decisions on this matter rendered between January 1, 2010, and January 1, 2025, and published in the relevant legal databases. The second part seeks an initial explanation for these data by identifying the types of actors who appear as applicants for exemption and the types of actors who appear as respondents to such applications. After rejecting this explanation, the third part offers a more persuasive account of the data: the identification of procedural and judicial patterns that shape this distinct procedural arena in a manner that grants respondents a structural advantage and places applicants at a structural disadvantage.

These three stages of analysis reveal a paradox. In an arena whose very purpose is to make law more accessible to the public, a systematic refusal to grant applications for exemption from court fees emerges – a pattern that restricts access and distances members of the public from the courthouse. A procedure that was meant to soften disparities of power functions in practice as a screening mechanism that operates most harshly against those seeking exemption. In doing so, it reproduces, rather than mitigates, the inequality it could and should have corrected.

The article's contribution is therefore twofold. First, it renders visible a hidden procedural configuration with significant distributive consequences. Second, through empirical description, it derives a systematic institutional explanation for the modes of institutional action that generate court-fee exemption decisions in practice. This analysis, in its several stages, makes it possible not only to identify the deep structural problems that characterize the fee-exemption process in this tribunal, but also to begin rethinking the proper design of that mechanism in this distinct procedural setting – a rethinking oriented toward possible future reform.
