אפשרות בחירת מין העובר באמצעות אבחון גנטי טרם השרשה מעלה שאלות אתיות, משפטיות וחברתיות כבדות משקל, בפרט ככל שמדובר בבחירה נטולת הצדקה רפואית, בחירה אותה נהוג לכנות "בחירה מטעמים חברתיים". הרשימה תעסוק בבחינת השיקולים העומדים ביסוד הקריאה להתרת בחירת מין היילוד מטעמים חברתיים וכן תצביע על שיקוליהם של אלה המבקשים למונעה. היא תציג את הטיעונים המקובלים בהקשר זה בספרות ותבחן את תוקפם, באופן כללי ובזיקה למציאות הישראלית. לצד המסקנה הגורסת כי מרבית הטיעונים המקובלים אינם חזקים דיים כדי להצדיק מניעת הגשמת רצון ההורה בהולדת ילד בן המין הרצוי לו, תבקש הרשימה להדגיש שיקול אחד, אשר עשוי להטות את הכף – השיקול המתמקד בילד. שיקול זה, הנוגע למעמדו של הילד העתיד להיוולד, לציבור הילדים בכללותו ולטיבם של יחסי ילדים-הורים, עשוי להצדיק, כפי שתטען הרשימה, הסדרה שתמנע כליל את אפשרות הבחירה האמורה. לאור העמדה העקרונית שתציע הרשימה, ייבחן ההסדר הישראלי שנקבע בחוזר מנכ"ל משרד הבריאות בחודש מאי 2005. ייחודו של ההסדר והקשיים שהוא מעורר לאור תוכנו, יתבררו במאמר.

The Legitimacy of Selecting the Offspring's Genetic Traits
– Non Therapeutic Sex Selection as a Test Case

Non-medical Sex Selection by Preimplantation Genetic Diagnosis (PGD) raises difficult questions – socially, ethically and legally. The paper will examine the varied arguments for and against allowing the use of PGD by parents who prefer a child of a certain sex while no medical reason is put forward for such a choice. The paper will claim that most arguments introduced by opponents of the Non-medical Sex Selection are ill founded, at least in Western democracies. However the argument that focuses on the particular child to be born and on the implications of sex selection to children in general might in fact point against allowing the use of PGD in these situations. The main concern that tips the balance is the potential negative influence that selection might have on parent-child relationships. In light of this discussion the paper will examine the Israeli legal arrangement, demonstrate its uniqueness and highlight its problematic characteristics.
