המאמר דן באחד ההיבטים של יחסי-הגומלין בין החוק לבין הסיפור במקרא. הוא מציג ומנתח את היסודות הספרותיים, הסיפוריים והרטוריים שקיימים בילקוט דיני המלחמה שבספר דברים. בעזרת מושגים כגון "סימולציה של דיאלוג", "דיאלוג מובלע", "מחוקק מתערב", "תגובת מחוקק", "נקודת-מבט" ו"ייצוג של דיבור" – השייכים כולם לשיח של תורת הספרות והנרטולוגיה – הוא חושף את הפנים המוכרים פחות של חוקי התורה. הבסיס המתודולוגי לקריאה המתחקה אחר הפואטיקה של החוק המקראי הוא במידה רבה המחקרים הנעשים בשנים האחרונות במסגרת אסכולת "משפט וספרות".

The Poetics of Deuteronomic Warfare Legislation

Abstract

The article considers one aspect of the relationship between law and narrative in the Bible. It presents and analyzes the literary, narrative and rhetorical elements found in the Deuteronomic laws of warfare. Using notions such as "dialogue simulation," "implied dialogue," "lawgiver's intervention," "lawgiver's response" "point of view," and "representation of speech"—all of which belong to the study of literature and narratology—enables us to expose the less familiar aspects of the laws of the Pentateuch. The methodological basis for a reading that traces the poetics of biblical law is to a great extent the contemporary research conducted in the framework of the "law and literature" movement.
